Terms of service
Last updated: 1 September 2026
1. About these terms and us
These Terms and Conditions (“Terms”) govern purchases from the Scandivv online store and use of its customer-facing services. The seller is:
Scandivv Group B.V., registered in Amsterdam, the Netherlands, Dutch Chamber of Commerce (KvK) number 99126605. Contact: support@scandivv.com.
By placing an order, you agree to these Terms. Nothing in these Terms excludes or restricts a mandatory consumer right that applies where you habitually live. If a provision conflicts with such a right, the mandatory rule prevails to the extent of the conflict.
You must have legal capacity to place the order. If local law permits a minor to purchase only with consent, the required parent or guardian must consent.
2. Product information
We aim to describe products, materials, dimensions, colours and images accurately. Screens and handcrafted or natural materials may show reasonable variations. A variation is not a defect where it is inherent in the material, disclosed, or reasonably expected, but your mandatory conformity rights remain unaffected.
Statements such as “waterproof”, when expressly made for a product, form part of the product description subject to any specific limits stated on that product page. Normal fresh-water contact within that claim is intended use and is not misuse. Care guidance about drying a product and avoiding chlorine, salt water, perfume, lotion, sunscreen, skincare or harsh chemicals is intended to extend its appearance and life; not following a recommendation does not automatically remove statutory rights or commercial-warranty coverage.
We may correct an obvious description or pricing error before accepting an order. If we discover a material error after acceptance, we will contact you and offer the lawful options, including cancellation and a full refund where we cannot supply as agreed.
3. Prices, currencies and taxes
The product price, currency, applicable tax and shipping amount are shown at or before checkout. Your payment provider may apply exchange-rate or account charges that we do not control.
Duties and import taxes are prepaid where Delivery Duty Paid (DDP) is available. If DDP is unavailable for the destination or shipment, we will contact you before dispatch, disclose a reasonable estimate based on the information available, and let you freely choose either:
- cancellation of the affected order for a full refund; or
- explicit acceptance of the disclosed estimate and non-DDP shipment.
We will not dispatch the affected order until you choose. This process is intended to prevent an unexpected customs bill after dispatch. If an authority charges an amount different from the estimate after your explicit acceptance, mandatory consumer rights and any express commitment we made still apply.
4. Orders and contract formation
The store’s order display is an invitation to place an order. You make an offer when you complete checkout. Automated receipt of an order confirms receipt, not necessarily acceptance. We accept the order when we send an acceptance or dispatch confirmation, take a separate action that clearly confirms acceptance, or dispatch the goods, whichever occurs first under applicable law.
Please check the order before submitting it. We may refuse or cancel an order before acceptance for genuine reasons such as unavailability, an obvious error, inability to authorise payment, suspected fraud, legal restrictions, or an unsupported destination. If payment was taken, we will refund the cancelled amount without undue delay.
An order may contain separate contracts for items dispatched separately where this is clear from the fulfilment confirmation.
5. Payment and fraud checks
Available payment methods are shown at checkout. Payment processing is provided by Shopify and/or the selected payment provider. You authorise the amount displayed at checkout and confirm that you are permitted to use the payment method.
We may use proportionate fraud and security checks. A check does not make you responsible for fraud you did not cause. We may ask for reasonably necessary verification, refuse a transaction, or cancel an order where there is a supported fraud or security concern. We will not require your full payment-card credentials by email.
6. Availability and pre-orders
Products are subject to availability. Inventory errors can occur. If an accepted item becomes unavailable, we will inform you without undue delay and offer a refund or, only with your agreement, an alternative.
A pre-order’s expected dispatch timing is an estimate unless expressly agreed as a guaranteed date. We will communicate a material delay and provide any cancellation or refund right required by law. Mixed baskets may dispatch together or separately as disclosed at checkout or in the order communication.
7. Delivery
We deliver to the countries and addresses offered at checkout. Processing and transit estimates appear on the Shipping page or at checkout. Estimates can be affected by carrier capacity, customs, public holidays, weather, local delivery attempts and events outside reasonable control.
We remain responsible for delivery as required by mandatory law. For consumers in the European Economic Area and United Kingdom, risk generally passes when you or a person you nominate, other than the carrier, physically receives the goods, unless you independently commissioned a carrier not offered by us. Title passes as provided by applicable law and after payment where permitted.
You must provide an accurate, deliverable address and cooperate with reasonable delivery arrangements. We will contact you about a failed delivery where possible. Nothing in this section makes you bear loss caused by our or our provider’s failure.
8. Withdrawal and returns
Eligible consumers may have a statutory right to withdraw from a distance contract, commonly within 14 days after delivery in the EEA and United Kingdom. The scope, deadline, exceptions, return process and refund timing are described in our Return Policy, which forms part of these Terms where applicable.
You may communicate withdrawal through any clear statement. We also provide the continuously available Withdraw from contract function linked in the store footer. It does not require an account or a reason. After a valid online submission, an acknowledgement containing the submitted information and its date and time must be sent without undue delay to the electronic address you provide. A technical problem with that function does not remove a statutory right to withdraw by another clear method, including email to support@scandivv.com.
Sealed earrings are not eligible for change-of-mind return after the hygiene seal or packaging has been opened where the applicable hygiene exception lawfully applies. This does not restrict remedies for a defective, damaged, incorrect or misdescribed product.
For a partial return from an order that originally received free Standard Shipping, if the value of the products kept falls below the free-shipping threshold that applied to the order, the original Standard Shipping charge may be deducted from the refund where permitted by applicable law and clearly disclosed. The Return Policy contains the full calculation and exceptions.
Return costs, permitted deductions, refund method and timing are set out in the Return Policy. Mandatory local rules prevail.
9. Damaged, incorrect or missing items
Please contact support@scandivv.com within 24 hours after delivery if an item arrives damaged, incorrect or missing. This operational timeframe helps us preserve carrier and fulfilment records, investigate promptly and request useful evidence such as packaging and photographs.
Missing the 24-hour request does not remove any mandatory legal right or remedy. We may request evidence that is reasonable and relevant to resolving the issue, but will not impose an evidence requirement that unlawfully prevents a claim.
10. Legal conformity rights and commercial warranty
Goods must comply with the contract and mandatory conformity law. Statutory rights can last longer than any commercial warranty and are not reduced by it.
In addition, Scandivv provides a three-month commercial warranty from delivery for manufacturing defects, subject to the Warranty and Care page. That commercial warranty does not replace, shorten or limit statutory rights. It excludes matters outside its stated scope, but an exclusion applies only where lawful and relevant to the issue.
Care recommendations are maintenance advice. Failure to follow one does not automatically prove misuse or remove coverage. In particular, normal fresh-water contact is not misuse for a product expressly sold as waterproof.
11. Promotions, discount codes and bundles
A promotion, reward, discount code or bundle may have additional terms disclosed with the offer. Unless stated otherwise, it:
- applies only during its stated period and to eligible products, markets and customers;
- cannot be exchanged for cash;
- may not be combined with another offer;
- cannot be applied retrospectively; and
- may be withdrawn or corrected before use if issued in error, abused or unlawful.
We will not remove a benefit already earned under an accepted consumer contract except where the offer terms and applicable law permit it. Returns from a discounted order are refunded based on the amount actually allocated to the returned item, subject to mandatory rights.
12. Gift cards
Gift cards are governed by the conditions shown when purchased or issued, including currency, territory, expiry and redemption limits. A gift card does not expire where expiry is prohibited. Statutory refund rights and rules for lost, stolen or fraudulently used cards remain unaffected.
13. Reviews, photographs and other submitted content
You retain ownership of content you submit. If you submit a review, photograph, video, testimonial or social-media content, any licence is limited to the terms clearly presented at submission or in the relevant programme terms. The Photo Reward Terms apply to that programme.
You confirm that you have the rights and permissions necessary for content you intentionally submit and that it does not unlawfully infringe another person’s rights. We may moderate or remove store content for lawful reasons such as fraud, illegality, infringement, privacy, harassment or irrelevance. We do not promise a reward unless it is expressly granted in writing under the applicable offer.
Consumer reviews must reflect genuine experience. We do not require a positive review as a condition of a reward unless the law permits and the incentive is transparently disclosed; our programmes should not be interpreted as doing so.
14. Intellectual property
The store’s design, branding, text, graphics, photographs, video, software and other materials are owned by or licensed to Scandivv and protected by applicable intellectual-property law. You may use the store for personal, lawful shopping and customer-service purposes. No ownership transfers to you except ownership of goods and your own content as provided by law.
You may not reproduce, scrape, exploit, bypass security, introduce malicious code, impersonate another person, interfere with the store, or use it to violate law or third-party rights. This does not prohibit lawful interoperability, quotation, consumer comparison, accessibility tools or other use protected by law.
15. Third-party services and links
The store may use or link to services provided by others, including payment, delivery, review and social-media services. Their separate terms apply when you choose or directly use those services. We remain responsible for our obligations and cannot avoid mandatory liability merely by using a service provider.
16. Liability
We are responsible for foreseeable loss caused by our breach of contract or failure to use legally required care. We do not exclude or limit liability where doing so is unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, intentional conduct, gross negligence where it cannot be limited, or mandatory product, conformity, privacy or consumer liability.
To the extent permitted by law, we are not responsible for loss that was not reasonably foreseeable when the contract was made, or for business loss arising from a consumer purchase. Any limitation is applied proportionately and does not deprive you of the contract’s essential remedy.
Nothing in these Terms shifts to you a risk that mandatory law places on us.
17. Events outside reasonable control
If an event outside our reasonable control delays performance, we will take reasonable steps to reduce its effect and communicate where appropriate. Your rights to terminate, obtain delivery within an additional period, or receive a refund under applicable law remain available. Payment problems, inventory management and supplier performance are not automatically treated as events outside our control.
18. Privacy
Our Privacy Policy explains how we process personal data. Cookie choices can be managed through the store’s cookie-preference control where available.
19. Complaints and customer service
Contact support@scandivv.com with your order number and a clear description of the issue. We will acknowledge and address complaints within a reasonable period and within any mandatory deadline.
You may also use an applicable court, regulator, consumer-protection body or out-of-court dispute procedure. We do not commit in these Terms to a particular optional dispute-resolution platform unless we separately confirm participation. Your right to seek a legal remedy is not restricted.
20. Governing law and courts
These Terms and contracts with Scandivv are governed by Dutch law. If you are a consumer habitually resident in another country, this choice does not deprive you of the protection of mandatory rules that would apply without the choice.
A consumer may bring proceedings in any court available under mandatory jurisdiction rules, including the courts of the place where the consumer is domiciled where applicable. Scandivv may bring proceedings against a consumer only in a court permitted by mandatory law.
21. Changes, severability and assignment
The Terms in force when the order is accepted govern that order unless a lawful change is agreed. We may update future-facing store Terms by posting a revised date. We will not retroactively reduce an accepted order’s rights without a lawful basis and, where required, agreement.
If a provision is invalid or unenforceable, the remainder continues to the extent legally possible, and the provision is read narrowly rather than expanded. A delay in enforcing a right is not a waiver.
We may transfer a contract as part of a genuine business reorganisation only where this does not reduce your guarantees or mandatory rights. You may transfer your rights where law permits.
